Creative-finance closings in Davidson County
Davidson County is Metro Nashville: the densest concentration of creative-finance deals in the state and the most title companies, closing attorneys, and investors who have seen a subject-to before. It is also where a file can sit in a queue if the title company does not know what it is holding.
Music City TC coordinates subject-to, seller finance, wrap, lease-option, and novation closings in Davidson County — Nashville, Antioch, Hermitage, Madison, Bellevue, Goodlettsville (part), Old Hickory, Joelton, Whites Creek — from signed contract to recorded deed. Flat fee per file. Within one business day of receiving your contract you have a written timeline and a named coordinator.
What's different about closing in Davidson County
- Where documents record: the Davidson County Register of Deeds in downtown Nashville. E-recording is accepted through the major e-recording vendors, which is how most closing agents file; a same-day recording is routine when the package is clean.
- Metro specifics to plan for: Metro Codes and the Short-Term Rental permit office matter if the exit is an STR; the permit does not transfer with the deed. Metro Water and NES utility transfers are scheduled, not instant, and we put them on the timeline.
- What we see most here: subject-to on 1990s–2010s loans in Antioch, Madison, and Hermitage; seller finance on free-and-clear houses in older East and North Nashville neighborhoods; wraps where the investor is reselling to an owner-occupant.
- Title companies: Nashville has the deepest bench of creative-finance-competent closers in Tennessee. We keep a short list and will place your file with one that has recorded your structure before.
Recording costs in Tennessee (the same in every county)
Tennessee sets recording taxes at the state level, so the numbers below apply here and in every other county in the state. The county register collects them when the documents are recorded.
| Item | Amount | Who usually pays |
|---|---|---|
| Realty transfer tax (on the deed) | $0.37 per $100 of consideration ($3.70 per $1,000) | Buyer, unless the contract says otherwise |
| Mortgage (recordation) tax on a deed of trust | $0.115 per $100 of indebtedness above the first $2,000, plus a $1 register fee when tax applies | Borrower |
| Recording fee, deed or deed of trust | $12 for the first two pages, $5 for each additional page | Whoever records |
| Required statement on every deed of trust | "Maximum principal indebtedness for Tennessee recording tax purposes is $____." Missing it, the register rejects the document. | — |
How that lands on a creative deal:
- Subject-to: the deed transfers, so transfer tax is due on the consideration stated. The existing deed of trust stays in place and is not re-recorded, so no new mortgage tax, unless a wrap note is also recorded.
- Seller finance: transfer tax on the deed, plus mortgage tax on the new seller-carry deed of trust (the note amount above $2,000).
- Wrap: transfer tax on the deed, plus mortgage tax on the wrap deed of trust. Some closing agents calculate the tax on the full wrap amount; confirm the treatment with the closing agent before the settlement statement is final.
- Novation: one deed, one transfer tax. The novation agreement itself is not recorded.
Rates come from Tennessee Code (T.C.A. 67-4-409 and 8-21-1001). Confirm current figures with the county register or the closing agent before closing; fees change by statute.
How a file runs here
- Soundcheck (day 1–2): timeline built and sent; title opened with the structure disclosed in writing; seller welcomed with a plain-language page.
- Load-in (day 2–14): lender authorization, payoff letter, entity documents, servicer setup, insurance quote, title commitment review, HOA letter if any.
- Rehearsal (day 14 to a week out): financing documents drafted by the attorney and checked against the addendum; settlement statement reviewed line by line; seller gets every document to read before closing day.
- Showtime and Encore: signings, funding, recording at the Davidson County register; servicer, insurance, and lender notified; closing recap and Wrap Card delivered.
