Creative-finance closings in Williamson County

Williamson County is higher-priced, HOA-heavy, and conservative at the closing table. Deals here are often seller finance or subject-to on newer-construction homes with large loan balances, which means the lender authorization, payoff letter, and insurance mortgagee clause carry more weight than anywhere else we work.

Music City TC coordinates subject-to, seller finance, wrap, lease-option, and novation closings in Williamson County — Franklin, Brentwood, Spring Hill (part), Nolensville, Thompson's Station, Fairview, College Grove — from signed contract to recorded deed. Flat fee per file. Within one business day of receiving your contract you have a written timeline and a named coordinator.

What's different about closing in Williamson County

  • Where documents record: the Williamson County Register of Deeds in Franklin. E-recording is accepted; most Franklin and Brentwood closing agents use it.
  • HOAs: nearly every subdivision has one. The HOA status letter and any transfer or capital-contribution fee go on the timeline on day two, because some management companies take two weeks to answer and the fee can be several hundred dollars.
  • Loan balances: subject-to files here commonly carry balances well into six figures. We confirm the servicer, the escrow balance, and the next due date before the seller signs anything, and the insurance binder names the existing lender exactly as the servicer requires.
  • What we see most here: subject-to in Spring Hill and Nolensville on homes bought 2015–2021; seller finance from long-time owners in Franklin and Fairview; novations with a retail end buyer using a conventional loan.

Recording costs in Tennessee (the same in every county)

Tennessee sets recording taxes at the state level, so the numbers below apply here and in every other county in the state. The county register collects them when the documents are recorded.

ItemAmountWho usually pays
Realty transfer tax (on the deed)$0.37 per $100 of consideration ($3.70 per $1,000)Buyer, unless the contract says otherwise
Mortgage (recordation) tax on a deed of trust$0.115 per $100 of indebtedness above the first $2,000, plus a $1 register fee when tax appliesBorrower
Recording fee, deed or deed of trust$12 for the first two pages, $5 for each additional pageWhoever records
Required statement on every deed of trust"Maximum principal indebtedness for Tennessee recording tax purposes is $____." Missing it, the register rejects the document.—

How that lands on a creative deal:

  • Subject-to: the deed transfers, so transfer tax is due on the consideration stated. The existing deed of trust stays in place and is not re-recorded, so no new mortgage tax, unless a wrap note is also recorded.
  • Seller finance: transfer tax on the deed, plus mortgage tax on the new seller-carry deed of trust (the note amount above $2,000).
  • Wrap: transfer tax on the deed, plus mortgage tax on the wrap deed of trust. Some closing agents calculate the tax on the full wrap amount; confirm the treatment with the closing agent before the settlement statement is final.
  • Novation: one deed, one transfer tax. The novation agreement itself is not recorded.

Rates come from Tennessee Code (T.C.A. 67-4-409 and 8-21-1001). Confirm current figures with the county register or the closing agent before closing; fees change by statute.
